2. Nature of Services
Madeline Legal is an Australian online platform that provides AI-assisted document drafting, dispute organisation tools, debt recovery correspondence generation, motor vehicle accident correspondence generation, and other informational document assistance. The Service is a self-help tool only.
3. No Legal Advice
Madeline Legal does not provide legal advice, legal services, legal opinions, or legal representation. Nothing produced by the Service should be treated as legal advice. The information and documents generated are informational only and may not be appropriate for your particular circumstances.
4. No Lawyer–Client Relationship
Your use of the Service does not create a lawyer–client, solicitor–client, fiduciary, or any other professional relationship between you and Madeline Legal or anyone associated with it. If you require legal advice, you should consult a qualified Australian legal practitioner.
5. User Responsibilities
You agree to use the Service lawfully and in good faith. You must not use the Service to harass, defame, or mislead any person, or to pursue any unlawful, fraudulent, or vexatious purpose. You remain solely responsible for any document you generate, send, or rely upon.
6. Accuracy of User Information
You are responsible for the accuracy, completeness, and lawfulness of all information you provide. The Service generates documents based only on the information you submit. Inaccurate or incomplete information will produce inaccurate or incomplete documents.
7. AI Generated Content
The Service uses artificial intelligence to assist with drafting. AI-generated content may contain errors, omissions, or inaccuracies, and may not reflect current law. You must independently review and verify any generated document before relying on or sending it. Madeline Legal makes no representation that AI-generated content is accurate, complete, or suitable for any particular purpose.
8. Intellectual Property
All software, branding, content, and materials forming part of the Service are owned by Madeline Legal or its licensors and are protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal dispute. Documents you generate for your own dispute may be used by you for that purpose.
9. Payments and Fees
Some features of the Service are paid. Fees are displayed before purchase and are payable in Australian dollars unless otherwise stated. By completing a purchase, you authorise us (or our payment processor) to charge the applicable amount.
10. Refund Policy
Because generated documents are delivered digitally and immediately upon payment, fees are generally non-refundable once a document has been produced. Nothing in this clause limits your rights under the Australian Consumer Law. If you believe a fee has been charged in error, please contact us at ABN: 38707356579.
11. Website Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free access. The Service may be suspended for maintenance, upgrades, or reasons beyond our control. We are not liable for any loss arising from unavailability.
12. Limitation of Liability
To the maximum extent permitted by law, Madeline Legal is not liable for any indirect, incidental, consequential, or special loss arising from your use of the Service. Madeline Legal makes no guarantee of any legal outcome, recovery of money, settlement, court success, or resolution of any dispute. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid to Madeline Legal for the Service giving rise to the claim.
13. Indemnity
You agree to indemnify and hold harmless Madeline Legal, its officers, employees, and contractors from any claim, loss, damage, or expense arising from your use of the Service, your breach of these Terms, or your use of any generated document.
14. Third-Party Services
The Service may rely on or link to third-party providers (including AI providers, payment processors, and hosting services). We are not responsible for the acts, omissions, content, or policies of any third party, and your dealings with them are at your own risk.
15. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
